1. Introduction

These Terms of Service ("Terms") govern the use of Pocae ("the Platform"), a service that allows users to create customizable profile pages. By accessing or using the Platform, you agree to comply with these Terms. If you do not agree with these Terms, please do not use the Platform.

2. Acceptance of Terms

By registering or using the Platform, you agree to be bound by these Terms of Service, as well as our Privacy Policy and Cookie Policy, which are incorporated by reference. We reserve the right to modify or update these Terms at any time.

3. Eligibility

You must be at least 13 years of age to use the Platform. If you are under the age of digital consent in your country, you may only use the Platform with the consent of a parent or legal guardian.

By using the Platform, you represent and warrant that you meet these eligibility requirements. If you are a parent or guardian and you allow your minor child to use the Platform, you agree to be bound by these Terms and are responsible for their use of the Platform, including any actions taken under their account.

4. Account and Security

Account Registration

To use the Platform and access its features, you must create an account on the Platform. You can register using:

  • An email address
  • A google account

Username

You must choose a unique username. Your username will be visible to others and will be part of your public profile link. You agree not to select a username that:

  • Misleads others or impersonates any person, company, or organization,
  • Includes offensive, vulgar, or inappropriate language,
  • Infringes on any intellectual property or other rights.

Account Security

You are responsible for maintaining the security of your account and associated email address or Google account used for authentication.

5. User Content

Ownership and License

You retain ownership of the content you upload to the Platform. However, by uploading content, you grant Pocae a worldwide, royalty-free, transferable, non-exclusive, and sublicensable license to use, display, and distribute the content on the Platform. This license is valid for as long as your content remains published on the Platform.

Content Restrictions

You agree not to upload or post content that:

  • Violates any laws or regulations
  • Infringes on the intellectual property rights of others
  • Is defamatory, obscene, or offensive
  • Promotes discrimination, hatred, or violence

We reserve the right to remove any content that violates these Terms.

6. Platform Features and Limitations

Platform Features

The Platform allows users to create customizable profiles where each profile is designed as a k-pop photocard. The features and services provided may change from time to time at our discretion.

Platform Limitations

While we strive to provide a high-quality service, we do not guarantee that the Platform will be uninterrupted or error-free. We are not responsible for any outages, delays, or issues that may arise during your use of the Platform.

7. Plans & Payment

You may create and build your profile on Pocae for free. Payment is only required if you choose to publish your profile and make it publicly visible to others.

We offer two payment options to publish your profile and make it publicly accessible: a Lifetime Deal (permanent access) or 1-Year Pass (access for 12 months). Both options are processed securely via our payment processor.

Profile Publishing

While creating and customizing your profile is free, publishing requires payment. Upon successful payment, your profile becomes immediately accessible to others.

Lifetime Deal

A single payment grants permanent publishing rights for your profile. This license is perpetual, but we reserve the right to terminate access in cases of Terms violations, abuse, or fraudulent activity.

1-Year Pass

Yearly payment that automatically expires after 12 months. Your profile remains published until expiration. No automatic renewal - you must manually renew to maintain publishing access.

Payments and Refunds

All payments are final and non-refundable. By purchasing access, you acknowledge that digital services are made available immediately and expressly consent to and waive your right of withdrawal in accordance with EU consumer laws (Directive 2011/83/EU). You may unpublish your profile at any time but this does not entitle you to a refund.

Prohibited Activities

You agree not to bypass payment restrictions, share account access, or develop tools to circumvent our systems. We reserve the right to terminate access if misuse or payment system circumvention is detected.

8. User Conduct

You agree to use the Platform only for lawful purposes and in a manner that does not violate the rights of others. You may not:

  • Use the Platform to harass or harm others
  • Engage in spamming, phishing, or other deceptive practices
  • Interfere with the Platform's functionality or security

9. Intellectual Property

Platform Ownership

The Platform, including all software, content, and intellectual property, is owned by Pocae or its licensors. You are granted a limited, non-exclusive license to use the Platform according to these Terms.

User License

By using the Platform, you grant Pocae permission to use your uploaded content in accordance with these Terms and for the purpose of providing the services of the Platform.

10. Account Deletion

Account Suspension/Deletion

We reserve the right to suspend or delete your account if we determine, in our sole discretion, that you have violated these Terms. If your account is deleted, you may lose access to your content and data.

User's Right to Delete

You may delete your account at any time by contacting us or using the account settings options available within the Platform. Upon deletion, your content and personal data will be permanently removed from the Platform, subject to our Privacy Policy. Once deleted, this action is irreversible.

11. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data. By using the Platform, you consent to the collection and processing of your personal data in accordance with our Privacy Policy.

12. Cookies

The Platform uses cookies to improve the user experience. By using the Platform, you consent to the use of cookies as described in our Cookie Policy.

13. Liability and Disclaimers

Limitation of Liability

To the fullest extent permitted by law, Pocae is not liable for any indirect, incidental, or consequential damages arising out of your use or inability to use the Platform.

No Warranty

The Platform is provided "as is," and we make no warranties regarding its availability, security, or functionality.

14. Governing Law

These Terms are governed by the laws of France, without regard to conflict of law provisions. Failure to enforce any right or provision of these Terms does not constitute a waiver of such rights. If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms constitute the entire agreement between you and Pocae regarding your use of the Platform and supersede any prior agreements or understandings, whether oral or written.

15. Miscellaneous

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our control, including but not limited to natural disasters, strikes, or internet disruptions.

Severability

If any provision of these Terms is found to be invalid, the remaining provisions will remain in full force and effect.

16. Changes to These Terms of Service

We may update these Terms of Service from time to time. We encourage you to regularly review them to stay informed of any changes. In case of significant changes affecting your rights or obligations, we will inform you directly by email before they take effect.
